Please read these Terms of Use carefully before accessing or using the Hyjywae platform at hyjywae.com. By accessing or using our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services.

1. Definitions

Throughout these Terms, the following definitions apply:

Platform refers to the Hyjywae website, applications, tools, and all associated services accessible at hyjywae.com.

Company, we, us, or our refers to Hyjywae, operated from R282, Conray, Co. Leitrim, Ireland.

User, you, or your refers to any individual or entity accessing or using the Platform.

Content means all text, materials, exercises, assignments, videos, audio, graphics, code, and other information made available through the Platform.

Account refers to the registered profile created by a User to access the Platform's features and services.

2. Acceptance of Terms

By creating an Account, completing a purchase, or otherwise accessing any part of the Platform, you enter into a binding agreement with Hyjywae under these Terms of Use and any additional policies referenced herein, including our Privacy Policy.

If you are accessing the Platform on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms, and all references to "you" shall apply to that organisation.

We reserve the right to update or modify these Terms at any time. Continued use of the Platform after any such changes constitutes your acceptance of the revised Terms. We will indicate the date of the most recent revision at the top of this page.

3. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an Account or use the Platform independently. If you are under the applicable age of majority, you may only use the Platform under the supervision and with the consent of a parent or legal guardian who agrees to be bound by these Terms.

By using the Platform, you represent and warrant that all information you provide is accurate, current, and complete, and that you will maintain the accuracy of such information throughout your use of the Platform.

4. Account Registration and Security

4.1 Account Creation

To access certain features of the Platform, you must register for an Account. You agree to provide truthful, accurate, and complete information during registration and to keep this information up to date.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You must notify us immediately at contact@hyjywae.com if you suspect any unauthorised access to or use of your Account.

4.3 Account Responsibility

Hyjywae shall not be liable for any loss or damage arising from your failure to protect your Account credentials. You may not share your Account with any other person or allow others to access the Platform using your credentials.

4.4 Account Termination by User

You may close your Account at any time by contacting us at contact@hyjywae.com. Closure of your Account does not automatically entitle you to a refund of any fees paid.

5. Use of the Platform

5.1 Permitted Use

The Platform is intended for personal, non-commercial educational use unless you have entered into a separate written agreement with Hyjywae permitting commercial or organisational use. You may access and use the Platform solely for lawful purposes and in accordance with these Terms.

5.2 Prohibited Conduct

You agree not to:

a) Copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any purpose without our prior written consent.

b) Use the Platform to upload, post, or transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.

c) Attempt to gain unauthorised access to any part of the Platform, its servers, or any system or network connected to the Platform.

d) Use automated tools, bots, scrapers, or similar technologies to access, collect, or index any Content from the Platform without our express written permission.

e) Reverse engineer, decompile, or disassemble any software or technology underlying the Platform.

f) Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

g) Interfere with or disrupt the integrity or performance of the Platform or the data contained therein.

h) Use the Platform to transmit unsolicited communications, spam, or promotional materials.

i) Engage in any conduct that restricts or inhibits any other user's use or enjoyment of the Platform.

5.3 Compliance with Laws

You are responsible for ensuring that your use of the Platform complies with all applicable laws and regulations in your jurisdiction. Hyjywae makes no representation that the Platform or its Content is appropriate or available for use in all locations.

6. Intellectual Property

6.1 Ownership

All Content, design elements, software, trademarks, logos, and materials available on the Platform are the exclusive property of Hyjywae or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

6.2 Limited Licence

Subject to your compliance with these Terms, Hyjywae grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and its Content solely for your personal, non-commercial educational purposes.

6.3 User-Generated Content

If you submit, post, or share any content, feedback, ideas, assignments, or other materials through the Platform, you grant Hyjywae a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, adapt, publish, and display such content in connection with operating and improving the Platform.

You represent and warrant that you own or have the necessary rights to the content you submit, and that such content does not infringe the intellectual property rights or other rights of any third party.

6.4 Feedback

Any feedback, suggestions, or ideas you provide regarding the Platform may be used by Hyjywae without any obligation to compensate you, and without restriction.

7. Payments and Subscriptions

7.1 Fees

Certain features or programmes on the Platform require payment. All applicable fees will be clearly communicated to you prior to purchase. By completing a purchase, you authorise Hyjywae to charge the applicable fees to your designated payment method.

7.2 Billing

For subscription-based services, fees are billed in advance on a recurring basis as indicated at the time of purchase. You are responsible for ensuring your payment information remains current and accurate.

7.3 Taxes

All fees are exclusive of applicable taxes unless stated otherwise. You are responsible for any taxes, duties, or levies applicable to your purchase based on your location.

7.4 Refunds

Refund eligibility is determined by the specific programme or service purchased. Unless otherwise stated in the purchase terms, all sales are final. If you believe you are entitled to a refund, please contact us at contact@hyjywae.com within 14 days of your purchase.

7.5 Cancellation

You may cancel a subscription at any time through your Account settings or by contacting us. Cancellation will take effect at the end of the current billing period. No partial refunds will be issued for unused portions of a billing period unless required by applicable law.

8. Third-Party Services and Links

The Platform may contain links to third-party websites, services, or tools. These links are provided for convenience only. Hyjywae does not endorse, control, or assume responsibility for the content, privacy practices, or availability of any third-party resources.

Your use of third-party services is governed by the terms and policies of those third parties. We encourage you to review those terms before engaging with any external service.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and processing of your personal data as described in our Privacy Policy.

10. Disclaimers

10.1 No Warranty

The Platform and all Content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, Hyjywae disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2 Educational Outcomes

Hyjywae does not guarantee any specific learning outcomes, results, or career advancement as a result of using the Platform or completing any programme. Individual results will vary based on effort, experience, and other factors outside our control.

10.3 Service Availability

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without prior notice.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Hyjywae, its directors, employees, partners, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Platform.

In no event shall Hyjywae's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform exceed the greater of (a) the amount you paid to Hyjywae in the twelve months preceding the claim, or (b) one hundred euros (€100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such cases, the exclusions and limitations above apply to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Hyjywae and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your use of the Platform, your violation of these Terms, your violation of any third-party rights, or any content you submit through the Platform.

13. Suspension and Termination

13.1 Termination by Hyjywae

We reserve the right to suspend or terminate your Account and access to the Platform at our sole discretion, without notice or liability, if we reasonably believe that you have violated these Terms or engaged in conduct that is harmful to other users, the Platform, or Hyjywae.

13.2 Effect of Termination

Upon termination of your Account, your right to access the Platform and its Content will immediately cease. Provisions of these Terms that by their nature should survive termination shall remain in full force and effect, including but not limited to intellectual property provisions, disclaimers, limitation of liability, and indemnification.

14. Modifications to the Platform

Hyjywae reserves the right to modify, update, or discontinue any feature, programme, or aspect of the Platform at any time. We will endeavour to provide reasonable notice of material changes where practicable, but are not obligated to do so. Continued use of the Platform after any modification constitutes your acceptance of the change.

15. Governing Terms and Dispute Resolution

These Terms constitute the entire agreement between you and Hyjywae with respect to your use of the Platform and supersede all prior or contemporaneous agreements, representations, and understandings.

In the event of any dispute arising out of or in connection with these Terms or your use of the Platform, both parties agree to first attempt to resolve the matter through good-faith negotiation. If a resolution cannot be reached informally, the dispute shall be submitted to binding arbitration or resolved through the competent courts, in accordance with applicable law.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Accessibility and Language

These Terms are written in English. In the event of any translation being provided for convenience, the English version shall prevail in all circumstances.
